Privacy Policy

This Privacy Policy explains how Artisans Ambulatory Medical Care, doing business as Artisan Health ("we," "us," "our," or the "Practice"), collects, uses, shares, and protects information when you visit artisanhealth.org (the "Site"), contact us, or exchange text messages with us.
1. Relationship to our HIPAA Notice of Privacy Practices
We are a health care provider. Protected health information ("PHI") that we create or receive in the course of treating you, billing for your care, or operating the Practice is governed by the Health Insurance Portability and Accountability Act ("HIPAA") and by our separate Notice of Privacy Practices, not by this Privacy Policy. Our Notice of Privacy Practices governs only clinical PHI that we handle in the course of treatment, payment, and health care operations. It has no bearing on the Site, on general inquiries, or on our text messaging program. This Privacy Policy is the complete and only policy governing the Site and our text messaging program, and it is not superseded by our Notice of Privacy Practices.
This Privacy Policy covers information that is not PHI: information collected through the Site, through general inquiry forms, through our marketing, and the operational metadata associated with our text messaging program. Where the two documents overlap, the Notice of Privacy Practices controls with respect to PHI.
2. Information we collect
Information you provide directly
- Contact details. Name, mobile and landline telephone numbers, email address, and mailing address.
- Messaging consent records. The fact that you opted in to text messages, the date and time, the method of opt in (the consent form on the Site, or verbal consent given to a staff member), and any later opt out.
- Request details. Information you type into an appointment request, contact form, or text message conversation, which may include health information you choose to share with us.
- Insurance and demographic details submitted through intake or eligibility forms.
Information collected automatically
- IP address, browser type and version, device type, operating system, referring page, pages viewed, and timestamps.
- Cookies and similar technologies, as described in Section 7.
Information from other sources
- Referring providers, health plans, and clearinghouses, where permitted by law.
- Our technology vendors, including our telephony and messaging platform, which reports message delivery status and carrier responses to us.
3. How we use information
- To respond to your questions, requests, and messages.
- To schedule, confirm, remind, reschedule, and follow up on appointments and visits.
- To notify you about the status of orders, shipments, deliveries, prescriptions, or supplies, including tracking information.
- To handle billing, insurance, eligibility, and account matters.
- To operate, secure, troubleshoot, and improve the Site and our communications.
- To maintain records of consent and opt out, which we are required to keep.
- To comply with law, respond to lawful requests, and enforce our Terms of Service.
4. Text messaging (SMS and MMS)
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors who provide support services, such as our messaging platform and customer service providers, is permitted solely so that those services can be delivered to you. All other use case categories exclude text messaging originator opt in data and consent; this information will not be shared with any third parties.
We send text messages only to individuals who have given us prior express consent to be contacted at the mobile number they provided. Consent to receive text messages is never a condition of receiving care, purchasing anything, or using our services.
Your mobile number, your opt in record, and the content of your messages with us are used only to communicate with you and to operate the messaging program. We do not sell mobile numbers, and we do not license, rent, or otherwise disclose them to third parties for those parties' own marketing.
You can stop receiving messages at any time by replying STOP to any message from us. You can request help by replying HELP or by contacting us using the details in Section 15. Full messaging program terms, including message types and frequency, are in our Terms of Service.
Standard text messaging is not a secure or encrypted channel. Messages can be read by anyone with access to your device or your mobile account. Please do not send us sensitive health information by text unless you are comfortable with that risk, and tell us if you would prefer that we contact you by telephone or mail instead.
6. How we protect information
We maintain administrative, technical, and physical safeguards designed to protect information against unauthorized access, use, alteration, and destruction. These include access controls, encryption of data in transit, audit logging, and vendor due diligence. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
8. Data retention
We keep information for as long as needed for the purpose it was collected, and for as long as required by law and by our record retention obligations as a health care provider. Records of text messaging consent and opt out are retained for at least the period required by applicable telecommunications rules, even after you opt out, so that we can honor your opt out.
9. Your choices
- Text messages. Reply STOP to any message to opt out. Reply START to opt back in.
- Email. Use the unsubscribe link in any non essential email, or contact us.
- Telephone. Ask us to add you to our internal do not call list and we will honor it.
- Access and correction. Contact us to review or correct the contact information we hold about you.
Requests about your medical record are handled under our Notice of Privacy Practices.
Opting out of text messages does not remove you from care, and we will continue to reach you by other means for anything that requires your attention.
10. State privacy rights
Depending on where you live, you may have rights to know what personal information we collect, to request a copy, to request correction or deletion, and to appeal a denial of one of those requests. We do not sell personal information or share it for cross context behavioral advertising, so there is nothing to opt out of in that respect. We will not discriminate against you for exercising any of these rights.
Much of the information we hold is PHI or is part of a medical record, which is exempt from most state consumer privacy laws and is instead governed by HIPAA and by New York medical records law. To exercise a right, contact us using Section 15. We will verify your identity before acting on a request.
11. Children
The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13 through the Site. Information about minor patients is collected through their parent or legal guardian in the course of care and is handled as PHI.
12. Third party links
The Site may link to websites we do not control. We are not responsible for their content or their privacy practices. Review the privacy policy of any site you visit.
13. Where information is processed
We operate in the United States and our vendors process information in the United States. If you access the Site from outside the United States, you consent to processing here.
14. Changes to this policy
We may update this Privacy Policy. When we do, we will change the "Last updated" date above and post the revised policy on this page. Material changes to how we use mobile information will be posted before they take effect. Continued use of the Site after an update means you accept the revised policy.
